About This Policy

House Finder is a buyers agency that helps clients find, evaluate and acquire property to build and grow their investment portfolios. We respect your privacy and are committed to protecting your personal information.

This policy explains how we collect, hold, use and disclose your personal information, and how we comply with the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs"). By providing your personal information to us — including through our website, our LinkedIn lead forms, by email, by phone, or in person — you agree to it being handled as set out in this policy.

What Personal Information We Collect

The kinds of personal information we collect depend on how you interact with us. They may include:

Identity and contact details — your name, email address, phone number, and postal or residential address.

Professional details — your job title, employer or company name, and professional background (for example, where you submit an enquiry through LinkedIn).

Financial and investment details — information relevant to providing buyers agency services, such as your budget, borrowing capacity, investment goals, existing property holdings, and pre-approval status.

Enquiry and communication records — the content of your enquiries, our correspondence with you, file notes, and records of services we provide.

Website and technical data — where you use our website, information such as your IP address, browser type, pages visited and other analytics data (see section 9).

We will only collect personal information by lawful and fair means, and only where it is reasonably necessary for, or directly related to, our functions and activities.

How We Collect Your Personal Information

We collect personal information in a number of ways, including:

Directly from you — when you complete a LinkedIn Lead Gen form, submit an enquiry form on our website, call or email us, or engage us to provide buyers agency services.

Through LinkedIn — when you submit one of our lead forms on LinkedIn, LinkedIn passes us the contact and profile details you have chosen to share (such as your name, email, phone number, job title and employer), together with your responses to any questions in the form.

From third parties — such as referral partners, mortgage brokers, financial advisers, or publicly available sources, where it is reasonable and practicable to do so and you would expect us to collect your information this way.

Where we collect your information from someone other than you, we will take reasonable steps to make sure you are aware of the matters in this policy.

Why We Collect, Hold, Use and Disclose Your Information

We collect, hold, use and disclose personal information for purposes including:

  • responding to your enquiries and providing you with information you have requested;
  • providing buyers agency and property advisory services to you;
  • assessing your needs and matching you with suitable property and investment opportunities;
  • managing our relationship with you, including administration, billing and record-keeping;
  • sending you marketing and updates about our services where permitted (see section 7);
  • improving our services, website and client experience; and
  • complying with our legal and regulatory obligations.

If you do not provide the personal information we request, we may not be able to provide our services to you or respond to your enquiry.

Sensitive Information

We do not generally collect "sensitive information" (as defined in the Privacy Act, such as health information). If we ever need to collect sensitive information, we will only do so with your consent and where it is reasonably necessary for our functions, unless an exception under the Privacy Act applies.

Who We Disclose Your Information To

We may disclose your personal information to:

  • Service providers who help us run our business — for example, customer relationship management (CRM) systems, email and marketing platforms, IT and cloud hosting providers, and professional advisers;
  • Third parties involved in your property transaction — such as mortgage brokers, conveyancers, solicitors, accountants, and selling agents, where relevant to the services we provide and with your knowledge;
  • LinkedIn and other advertising platforms, in connection with lead generation and advertising;
  • Government bodies, regulators or law enforcement, where required or authorised by law.

We do not sell your personal information.

Direct Marketing and Your Choices

We may use your personal information to send you marketing communications about our services that we think may interest you, by email, phone, SMS or other channels, consistent with the Privacy Act and the Spam Act 2003 (Cth).

You can opt out of marketing communications at any time by:

  • using the unsubscribe link in any marketing email;
  • replying "STOP" to a marketing SMS; or
  • contacting us using the details in section 14.

If you ask us to stop, we will remove you from our marketing lists. We will not use or disclose your information for direct marketing if you have asked us not to.

Disclosure of Information Overseas

Some of our service providers — including LinkedIn and certain cloud, CRM and email platforms — are located overseas or store data overseas. This means your personal information may be disclosed to, or accessible from, recipients in countries including the United States and other jurisdictions where those providers operate.

Where we disclose personal information to overseas recipients, we take reasonable steps to ensure it is handled consistently with the APPs.

Cookies and Website Analytics

Where you use our website, we (and our analytics or advertising providers) may use cookies and similar technologies to understand how visitors use the site and to improve it. You can manage or disable cookies through your browser settings, although some parts of the site may not function properly if you do.

How We Store and Protect Your Information

We hold personal information in electronic and, where relevant, physical form. We take reasonable steps — including technical and organisational measures — to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure.

If we experience a data breach that is likely to result in serious harm to affected individuals, we will respond in accordance with the Notifiable Data Breaches scheme under the Privacy Act, including notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) where required.

How Long We Keep Your Information

We keep personal information only for as long as it is needed for the purposes described in this policy, or as required by law. When it is no longer needed, we take reasonable steps to destroy or de-identify it.

Accessing and Correcting Your Information

You have the right to request access to the personal information we hold about you and to ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details in section 14. We will respond within a reasonable period. There is generally no charge to make a request, although we may charge a reasonable fee for giving access in some circumstances. If we refuse access or correction, we will tell you why in writing.

Complaints

If you believe we have breached the APPs or mishandled your personal information, please contact us using the details in section 14. Please describe your complaint in writing where possible. We will acknowledge your complaint and aim to resolve it within a reasonable period.
